TERMS OF SERVICE

1. ACCEPTANCE OF TERMS

These Terms of Service constitute a legally binding agreement between you (the "Client," "you," or "your") and Home Focus ("Home Focus," "we," "us," or "our") governing your use of our goal-focused real estate planning and decision support services. By accessing our services, scheduling a consultation, or engaging with Home Focus in any capacity, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service. If you do not agree to these terms, you must not use our services.

2. SERVICE DESCRIPTION

Home Focus provides goal-focused real estate planning and decision support services designed to assist buyers and sellers in making informed real estate decisions. Our services include, but are not limited to:

Goal-Based Home Plan: We work with clients to develop customized real estate plans aligned with their personal, financial, and lifestyle goals. This service includes goal assessment, needs analysis, and strategic planning tailored to individual circumstances.

Decision Support & Guidance: We provide objective analysis, market insights, and decision-making frameworks to help clients evaluate real estate options, weigh alternatives, and make confident choices in buying or selling property.

Timeline & Strategy Alignment: We assist clients in creating realistic timelines and strategic approaches for their real estate transactions, coordinating planning activities with personal schedules, financial readiness, and market conditions.

Home Focus provides consultation, planning, and advisory services only. We are not real estate agents, brokers, or licensed real estate professionals unless otherwise stated. Our services do not include property transactions, legal advice, financial advice, tax advice, or professional services requiring specific licensure. Clients are responsible for engaging appropriate licensed professionals for transactions, legal matters, financing, inspections, and other specialized services.

3. USER OBLIGATIONS

By engaging with Home Focus, you agree to:

Provide accurate, complete, and truthful information about your goals, financial situation, timeline, and other relevant factors necessary for us to provide effective services.

Respond to our communications in a timely manner and maintain reasonable availability for scheduled consultations and follow-up discussions.

Use our services for lawful purposes only and in accordance with these Terms of Service.

Respect the intellectual property rights of Home Focus, including proprietary methodologies, planning tools, templates, and materials provided during our engagement.

Not reproduce, distribute, modify, or create derivative works from our proprietary materials without express written permission.

Maintain confidentiality of any login credentials, portal access, or other account information provided by Home Focus.

Understand that our services are advisory in nature and that you retain full decision-making authority and responsibility for all real estate decisions and actions.

Engage qualified licensed professionals, including real estate agents, attorneys, financial advisors, and inspectors, as appropriate for your transaction.

4. APPOINTMENT SCHEDULING AND CANCELLATIONS

Scheduling: Appointments may be scheduled through our designated booking system, by email, or by phone. All appointments are subject to availability and confirmation by Home Focus.

Confirmation: You will receive confirmation of scheduled appointments via email. It is your responsibility to ensure we have your current contact information.

Cancellations and Rescheduling: If you need to cancel or reschedule an appointment, you must provide at least 24 hours advance notice by contacting us at Lincoln.Miller@homefocus.info. Cancellations made with less than 24 hours notice may result in forfeiture of the appointment or assessment of a cancellation fee, depending on the service package purchased.

No-Show Policy: Failure to attend a scheduled appointment without prior notice constitutes a no-show. No-shows may result in forfeiture of the scheduled session with no refund or credit provided.

Our Cancellations: Home Focus reserves the right to cancel or reschedule appointments due to emergencies, illness, or unforeseen circumstances. We will make reasonable efforts to provide advance notice and reschedule at a mutually convenient time.

5. PAYMENT TERMS

Fees: Service fees vary based on the scope and type of services requested. All applicable fees will be communicated to you prior to engagement and must be agreed upon before services commence.

Payment Methods: We accept payment methods as specified during the booking or contracting process. Payment information must be accurate and current.

Payment Timing: Unless otherwise agreed in writing, payment is due prior to or at the commencement of services. For ongoing or multi-session engagements, payment terms will be specified in the service agreement.

Refund Policy: Fees for completed services are non-refundable. For multi-session packages, refunds for unused sessions may be considered on a case-by-case basis at the sole discretion of Home Focus, subject to a cancellation or administrative fee.

Late Payment: Failure to pay fees when due may result in suspension of services until payment is received. Overdue balances may be subject to late fees or collection actions.

Third-Party Costs: Home Focus is not responsible for any costs you incur with third-party service providers, including but not limited to real estate agents, attorneys, inspectors, lenders, or other professionals.

6. LIMITATION OF LIABILITY

To the maximum extent permitted by applicable law, Home Focus, its owners, employees, contractors, and affiliates shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from or related to:

Your use of or inability to use our services.

Any decisions you make based on information, guidance, or recommendations provided by Home Focus.

Any real estate transaction or investment decision, including but not limited to property purchases, sales, timing decisions, or financial outcomes.

Any loss of profit, revenue, data, or business opportunities.

Any errors, omissions, or inaccuracies in information provided.

Any actions or omissions of third-party service providers you engage.

Our total aggregate liability for any claims arising from our services shall not exceed the total amount paid by you to Home Focus for services in the six months preceding the claim.

Home Focus provides planning and decision support services based on information you provide and market conditions as they exist at the time of consultation. Real estate markets are inherently unpredictable, and outcomes cannot be guaranteed. You acknowledge that all real estate decisions carry inherent risks and that you assume full responsibility for your decisions and their outcomes.

7. WARRANTY DISCLAIMERS

Our services are provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

Home Focus does not warrant that:

Our services will meet your specific requirements or achieve your desired outcomes.

Our services will be uninterrupted, timely, secure, or error-free.

The information and guidance provided will be accurate, complete, or current in all circumstances.

Any particular result will be achieved through the use of our services.

Market conditions, property values, or real estate opportunities will develop as anticipated.

You acknowledge that real estate planning involves numerous variables beyond our control, including market fluctuations, economic conditions, personal circumstances, and decisions made by other parties. Home Focus makes no guarantees regarding timing, property values, investment returns, or successful transaction outcomes.

The guidance and recommendations we provide are based on information available at the time of consultation and our professional judgment. However, they do not constitute guarantees or warranties of any kind. You are encouraged to conduct your own independent research and consult with licensed professionals before making real estate decisions.

8. INTELLECTUAL PROPERTY

All content, materials, methodologies, tools, templates, reports, and other intellectual property provided by Home Focus remain our exclusive property. This includes but is not limited to proprietary planning frameworks, decision-making tools, assessment instruments, and strategic methodologies.

You are granted a limited, non-exclusive, non-transferable license to use materials provided to you solely for your personal real estate planning purposes. You may not reproduce, distribute, publicly display, sell, or create derivative works from our materials without express written permission.

Any feedback, suggestions, or ideas you provide to Home Focus regarding our services may be used by us without obligation or compensation to you.

9. CONFIDENTIALITY AND PRIVACY

Home Focus respects your privacy and maintains the confidentiality of information you share with us during the course of our engagement. We collect and use personal information only as necessary to provide our services and communicate with you.

Information you provide, including personal goals, financial information, and property preferences, will be kept confidential and not shared with third parties except:

10. INDEPENDENT RELATIONSHIP

The relationship between you and Home Focus is that of an independent contractor providing advisory services. Nothing in these Terms of Service creates a partnership, joint venture, employment, or agency relationship. Home Focus is not your fiduciary, legal representative, or real estate agent unless a separate written agreement explicitly establishes such a relationship.

You acknowledge that Home Focus may serve multiple clients simultaneously and is not obligated to inform you of services provided to others or to avoid potential conflicts in general market advisory services.

11. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless Home Focus, its owners, employees, contractors, and affiliates from and against any claims, liabilities, damages, losses, costs, or expenses, including reasonable attorneys' fees, arising from or related to:

Your violation of these Terms of Service.

Your violation of any rights of third parties.

Any real estate decisions or transactions you undertake.

Any misrepresentation or omission of information you provide to us.

This indemnification obligation survives termination of services and these Terms of Service.

12. TERMINATION

Either party may terminate the service relationship at any time with written notice to the other party. Termination does not relieve you of the obligation to pay for services already rendered.

Upon termination, you must cease using any proprietary materials provided by Home Focus and return or destroy such materials as directed.

Home Focus reserves the right to terminate services immediately without notice if you breach these Terms of Service, provide false information, engage in abusive behavior, or use our services for unlawful purposes.

Sections of these Terms of Service that by their nature should survive termination shall survive, including but not limited to provisions regarding payment obligations, intellectual property, limitation of liability, warranty disclaimers, indemnification, and governing law.

13. GOVERNING LAW AND DISPUTE RESOLUTION

These Terms of Service shall be governed by and construed in accordance with applicable law. Any disputes arising from or relating to these Terms of Service or our services shall be resolved through good faith negotiation between the parties.

If negotiation does not resolve the dispute within 30 days, either party may pursue available legal remedies. You agree that any legal action must be brought on an individual basis and not as part of a class action or representative proceeding.

14. SEVERABILITY

15. ENTIRE AGREEMENT

No waiver of any provision of these Terms of Service shall be deemed or constitute a waiver of any other provision, nor shall any waiver constitute a continuing waiver unless otherwise expressly provided.

Home Focus reserves the right to modify these Terms of Service at any time. Changes will be effective immediately upon posting or notification. Your continued use of our services after changes are posted constitutes your acceptance of the modified terms.

Material changes that significantly affect your rights or obligations will be communicated to you via email or through prominent notice on our website or service portal. It is your responsibility to review these Terms of Service periodically.

If you do not agree to modified terms, you must discontinue use of our services. Continued use constitutes acceptance of the changes.
